The Supreme Moderator of a pontifical religious institute, due to the decreasing number of members and their advanced age, petitioned the Congregation for Institutes of Consecrated Life and Societies of Apostolic Life for the appointment of a Pontifical Commissary, with authority for the canonical governance of the institute. In response to the request, the Congregation issued a decree appointing the Supreme Moderator of another institute as the Pontifical Commissary. The response from the Archbishop Secretary of CICLSAL and the decree follow.

Enclosed please find the Decree with which this Dicastery, after having considered the request of the _______, an Institute of Pontifical Right.

After having carefully considered the reasons presented by the Supreme Moderator and the actual situation of the Institute, now reduced to few in number, most of whom are of a very advanced age, this Congregation has deemed it appropriate to proceed with urgency to provide the Institute with a safe and sure support both at the present time and for the future.

As indicated in the text of the Decree, you are entrusted with the governance of the Institute in accordance with the Constitutions. In close and fraternal dialogue with the Sisters, you will see to their needs ensuring the welfare of their personal and community life. For this mission, especially as regards administrative matters, you can seek help from experienced people whom you trust. For the daily regular life, following appropriate consultation, you may appoint as your delegate the current Supreme moderator, or any other Sister.

Further, as stated in the Decree, for any matter of importance, especially for those which you deem are beyond the scope of ordinary government, we ask you to consult this Dicastery.

While thanking you for your willingness to assume this nomination and for the care of this life of special consecration, we remain at your disposal for any request for clarification and help.

Confident that the Sisters will manifest a full and trusting collaboration, I welcome this opportunity to extend a fraternal greeting of peace and to wish you a Happy New Year.

DECREE

It is the responsibility of the Congregation for Institutes of Consecrated Life and Societies of Apostolic Life to oversee the life of the Institutes, particularly with regard to their promotion, religious discipline and internal governance.

Given the present needs of _______, an Institute of Pontifical Right, whose principal house is located in the Diocese of _______ due to their reduction in numbers and the advanced age of their members, and considering the request made by the Supreme Moderator with the consent of her Council and all the Sisters, received in this Dicastery on November 12, 2014, and in order to ensure safe and sure support in these difficulties, this Dicastery with the present Decree appoints and nominates:

All rights and obligations of the universal law of the Church and the proper law of the Institute attributed to the Supreme Moderator and her Council are to be assumed by the Pontifical Commissary. If necessary, regarding any matter that goes beyond the scope of the internal authority established by the Constitutions, the Pontifical Commissary will seek the advice of this Dicastery and follow the instructions given.

In addition to the normal powers of government, the Pontifical Commissary is to maintain constant and open dialogue with the Sisters, seeing to their spiritual and material needs and making choices that will ensure, as far as possible, the pursuit of a peaceful regular community life.

In carrying out its mandate, the Pontifical Commissary has the right to be assisted by a competent person or persons of her choice.

All the Sisters of _______ are to accept this decision in a spirit of faith, to willingly cooperate with the Commissary, contributing to the good of the Institute and of consecrated life in the Church.

All things to the contrary notwithstanding.
