The man's wife died and he sought a dispensation to remarry while remaining an active deacon. Your Excellency:

The request of _____, a Chaldean Catholic, who, by indult of the Apostolic Pro-Nuncio, was permitted to be ordained to the permanent diaconate in the Latin Church for the Diocese _____ of while retaining membership in the aforementioned sui iuris Church, for dispensation from the requirement of canon 1087, in order that he might marry another woman while remaining in the diaconal ministry, has received the attentive study of this Congregation for Divine Worship and the Discipline of the Sacraments.

Since the Circular Letter of the Congregation for Divine Worship and the Discipline of the Sacraments (Prot. n. 269/97), dated June 6, 1997 pertains only to requests of permanent deacons who are members of the Latin Church, this request is not able to be granted.

Indeed, this congregation is able to inform Your Excellency that such requests of deacons of the Oriental Rites cannot be entertained.

In the awareness that the only other possibility for Deacon _____ should he persist in his desire to enter another marriage, would be that of requesting dispensation from the obligations of the permanent diaconate, it is asked that Your Excellency would warmly exhort him to continue in sacred ministry as a celibate deacon.
