A small diocesan community petitioned a larger one to consider the possibility of a merger. Both institutes share the same nature, spirit, and end. The larger religious institute of pontifical right responded affirmatively to the request and both institutes involved their respective members in the spiritual, psychological and canonical implications of the process. In a preliminary referendum, an overwhelming majority of religious in both institutes responded positively to the merger. The general superior of the smaller institute wrote to the Congregation for Institutes of Consecrated Life and Societies of Apostolic Life (CICLSAL) inquiring as to the proper procedure and necessary documents to complete the merger. This letter and the reply of the Congregation were published under canon 582 in Roman Replies 2002. Both institutes completed the process and petitioned for the merger. The general superior of the merging institute received the following letter and rescript from the Congregation for Institutes of Consecrated Life and Societies of Apostolic Life.

DECREE

The general coordinator of the _____ of diocesan right, whose generalate is located in the Diocese of _____, having received the consent of the sisters, has petitioned the Apostolic See that the institute be permitted to merge with the _____ of pontifical right, with its generalate in the Archdiocese of _____.

The General Council of the _____ held on _____, unanimously voted in favor of the above mentioned merger.

The Congregation of Institutes of Consecrated Life and Societies of Apostolic Life, having carefully examined the matter, by this decree grants permission to the _____ to merge with the _____.

All the sisters who transfer to the _____ remain in the same juridical condition in which they are at present. A new religious profession is not required.

Furthermore, all goods, both movable and immovable of the _____ shall be duly ascribed to the _____, as agreed in their preliminary statement.

Special funds or pious bequests, if there be any, must be used for the purposes intended by the donor or testator; likewise, the rights of others, if there be any, must be preserved intact insofar as the case demands.

All things to the contrary notwithstanding.
