Congregation for the Doctrine of the Faith, Petition to dissolve a marriage between partners who always had sexual intercourse when using a condom, 2006, Private.

A woman petitioned the Congregation for the Doctrine of the Faith for the dissolution of her marriage in favor of the faith. The petitioner was baptized in the Catholic Church twenty-two years after the marriage, and the couple lived as husband and wife thereafter for eight more years. The petitioner stated, however, that sexual intercourse took place with the use of a condom. What follows is the Congregation's response, in English:

CONGREGATIO PRO DOCTRINA FIDEI

Your Grace:

The Congregation has carefully examined the petition submitted by _____ through your diocesan curia for the dissolution of her marriage to _____ in favor of the faith.

Married in _____, the Petitioner was baptized in the Catholic Church in _____, and thereafter the couple lived as husband and wife. Regarding the question of consummation, our letter to Your Grace, dated _____, indicated that "it is not possible to obtain dissolution of marriage in favor of the faith if the non-baptized person is baptized and then sexual intercourse takes place with the use of a condom."

With this letter, therefore, I must inform your grace that the Congregation had determined that the request of _____ cannot be presented to the Holy Father.

With every good wish, I remain

Yours devotedly in the Lord,
