A diocesan bishop learned from his vicar for religious that a sui iuris monastery in the diocese had five nuns in their eighties, three of whom were infirm. The vicar reported that during his annual visitations to the monastery, he repeatedly requested that the nuns look to their future and plan for the suppression of the monastery, since the infirm nuns needed provision for assisted living and no vocations were forthcoming for a number of years. However, the nuns refused to take any steps towards the suppression of the monastery and providing for their own retirement needs. The bishop took recourse to the Congregation for Institutes of Consecrated Life and Societies of Apostolic Life (CICLSAL) and received the following response:

Decree

The Congregation for Institutes of Consecrated Life and Societies of Apostolic Life, because of the declining number of Nuns and the difficulty for the aging Community, with this present Decree decides to suppress the Monastery of _____ in the diocese of _____.

The Nuns must move to other Monasteries of the same Order, which will be ready to accept them with the same rights and duties which the Nuns enjoyed in their Monastery.

Pious legacies, if there be any, must be used for the purpose intended by the donor or testator; likewise, the rights of others, if there be any, must be preserved intact insofar as the case demands.

It pertains to the Bishop of _____ to execute this Decree and to inform this Congregation about its execution.

All things to the contrary notwithstanding.

I, the undersigned bishop of _____, having received the Decree (Prot. N. ___) of the Congregation for Institutes of Consecrated Life and Societies of Apostolic Life, suppressing the Monastery of the Sisters of _____, in the Diocese of _____, have examined it and judge it to be authentic. Having been entrusted by the same Congregation with the Decree’s execution, I do hereby execute it in conformity with the provisions of canon 41 of the Code of Canon Law.

In conformity with the provision of canon 54 §1, the decree takes effect immediately.

All things to the contrary notwithstanding.
