The case concerns a scholastic in a clerical institute of pontifical right. He made temporary profession with his classmates in February 2001. In October, he was transferred to a house of studies in another country, where temporary profession was made in September. In September 2002, he renewed his vows for one year with his new classmates.

The superiors later became aware that the scholastic had remained without temporary vows for seven months, while living a regular religious life. The case was sent to the Congregation for Institutes of Consecrated Life and Societies of Apostolic Life with a request for a sanatio. The Congregations sent the following reply in Italian, which has been translated below:




CONGREGAZIONE PER GLI ISTITUTI DI VITA CONSACRATA E LE SOCIETA DI VITA APOSTOLICA

Reverendo Padre:

Rispondo alia Sua richiesta di sanatio della situazione irregolare in cui si trova lo scolastico _____ delle sciasticato di _____, rimasto senza voti dal _____ fine al _____.

Le dirò, Padre Procurators che la situazione è certamente irregolate, ma non porta con sè nessuna invalidita che richieda la sanatio. Basta che i superiori la tengano presente quando si tratti di ammettere lo scolasticl ai voti perpetui. I voti religiose sono teologicamente perpetui fin dalla prima emissione temporanea. La temporaneità si riferisce soltanto ad alcuni effetti giuridici come la possibilità di no essere ammesso al rinnovo oppure la libertà di andarsene alia scandenza senza dover rendere conto a nessuno. Le uniche cause di nullitd sono quelle espresse ne canoni 656 e 658, oppure espresse positivaments nelle Costituzioni dell'istituto.

I am answering your request for a sanatio concerning the irregular situation of scholastic of _____ the scholasticate of _____, who remained without vows from _____ until _____.

I will say, Father Procurator, that the situation is in fact irregular; however, it

implies no invalidity that would demand a sanatio. It will suffice that the Superiors keep it in mind when the time comes to admit said scholastic to the perpetual vows. Religious vows are theologically perpetual right from the first temporary profession. Their temporal character refers only to some juridical effects, e.g., the possibility (for the candidate) not to be admitted to renew, or the freedom (of the candidate) to leave upon expiration without having to render account to anyone. The only causes of invalidity are those expressed in canons 656 and 658, or positively stated in the Constitutions of the Institute.
