At the request of the Eparchial bishop of Our Lady of Deliverance of the Syriacs that the adjudication of judicial cases of the Christian faithful of the eparchy living in the United States be committed to the tribunal of the Eparchy of Saint Maron of Brooklyn, the Apostolic Signatura issued a decree, responding to the request. An unofficial English translation of the decree is presented, followed by the original Latin decree.




UNOFFICIAL ENGLISH TRANSLATION

SUPREME TRIBUNAL OF THE APOSTOLIC SIGNATURA

With the apostolic constitution Principis Apostolorum, the Roman Pontiff John Paul II erected in 1995 the Eparchy for the Syriac Christian faithful of the Antiochene Church in the United States of America also with jurisdiction for those residing in Canada named under the title of Our Lady of Deliverance of the Syriacs.

With the decree of 20 March 1997, the Apostolic Signatura committed the judicial cases of this eparchy to the eparchial tribunal of the Eparchy of Saint-Sauveur de Montréal for the first instance until provided otherwise.

With the letter of 26 January 2012, the Most Reverend Eparchial bishop of Our Lady of Deliverance petitioned that, without prejudice to the decree of 20 March 1997 for the Canadian Christian faithful of the eparchy, that judicial cases of the Christian faithful in the United States of America of the eparchy be committed for adjudication to the tribunal of the Eparchy of Saint Maron of Brooklyn for the Maronites.

In consideration of the foregoing, the Supreme Tribunal of the Apostolic Signatura, having carefully examined the matter and considered the reasons;

Given that the Most Reverend Moderators of the tribunal of Saint Maron of Brooklyn for the Maronites and of the tribunal of Newton for the Melkite Greek Catholics gave their consent;

Having heard the Reverend Promotor of Justice;

In virtue of art. 124, n. 3 of the Apostolic Constitution Pastor bonus (cf. also CIC c. 1445 §3, n. 2) and art. 35, n. 3 of the proper law by which this Supreme Tribunal is governed [Pope Benedict XVI, mp Antiqua Ordinatione, 21 June 2008-ed.],

decreed:

That requested extension be granted so that, without prejudice to the decree of 20 March 1997 for the Christian faithful in the jurisdiction of Canada, judicial causes for the Christian faithful in the Eparchy of Our Lady of Deliverance for the Syriacs residing in the United States of America be committed to the tribunal of Saint Maron of Brooklyn for the Maronites in the first instance to be examined and resolved.
