A major superior sought an indult from the Congregation for Institutes of Consecrated Life and Societies of Apostolic Life (CICLSAL) prior to institute’s Chapter for the possible postulation of members who had already served the two terms in general government permitted by the institute’s Constitutions. The Holy See’s response reminded the superior of the requirements for a valid postulation and indicated that a dispensation could not be granted in advance of the election. The response of the CICLSAL follows:

Dear Sister _______,

This letter comes in response to yours of 4 January 2008, regarding the General Chapter of the _______, scheduled for _______, 2008. You have asked how to proceed in the face of the possible postulation of members of the General Government who have already served the two terms permitted by your Constitutions.

While this is an impediment which can be dispensed, in order to leave the Chapter fully free, it is not the practice of this Dicastery to grant a dispensation in elections before the Chapter. In the event that there is the postulation of any of these persons, according to the canonical norms (cc. 180-183), it can be sent to us immediately by fax, and we will make every effort to respond the next day. With the time difference, your fax would arrive when we are closed on March 31, but we would have the full day on April 1 to reach you during your day.

In cases of postulation, it is important to include that it took place on the first or second ballot, that there was the necessary 2/3 vote for postulation, and to indicate again briefly the reasons for postulation. The person who is presiding during the election, and/or Bishop _______, can forward the request. It will facilitate the matter also to make reference to the above protocol number.
