A Union of Seven Religious Institutes

Rescripts and Decree of Erection

Seven religious institutes having the same nature, spirit, and end petitioned the Congregation for Institutes of Consecrated Life and Societies of Apostolic Life (CICLSAL) for permission to unite as one. The following is the first rescript from CICLSAL:

Dear Sister ______,

We are pleased to inform you that in a Congresso held on the ______ of ______, ______, this Congregation for Institutes of Consecrated Life and Societies of Apostolic Life approved the request for the union of the seven Institutes of ______ of ______ which has been submitted.

We have received a request that a decree be issued on ______. Prior to the issuance of said decree this Dicastery requires some clarification.

Is it the intention that the new Institute come into being at the opening of the General Chapter (______) or rather at a later date?

Upon erection of the new Institute, the seven constitutive Institutes will cease to exist, consequently leadership of the new Institute must become effective at that time.

If the Institute comes into being at the opening of the General Chapter, then the newly elected Government must assume leadership at that time.

It would also be possible that the date of the erection of the new Institute is later than the actual election in which case the present administrations of the seven Institutes would retain their positions until the effective date of erection stated in the Decree. As such time, the seven institutes will cease to exist and the new leadership will take office. We ask that you kindly send us the requested information. Upon reception of that information we will be able to proceed with the preparation of the Decree. May the Lord abundantly bless you and all the sisters who will join in this new endeavor.

The communication caused some confusion among the leadership of the institutes, inasmuch as there could be no new government until the general chapter elected the supreme moderator and council. A fax was sent to CICLSAL seeking clarification of the above communication. The following is the second rescript:

Dear Sister ______,

Your fax of ______ has been received in this Congregation for Institutes of Consecrated Life and Societies of Apostolic Life.

Upon reflection it was decided that the decree would be issued dated ______ and that it will go into effect on ______, in order that the new Institute will already have been established at the opening of the Chapter.

The date on which the new Government will take effect is to be established by a decision of the Chapter, either immediately or on a future date to be chosen and established by a Chapter Decision.

The present Administrations will remain in effect until such time as decided by the Chapter.

DECREE

The Superiors General of ______ of ______, of ______, of ______, of ______, of ______, and of ______, having received a majority of affirmative votes from the members of their respective Communities, have petitioned the Apostolic See to have their Religious Institutes united into a single Religious Institute of Pontifical Right.

This Congregation for Institutes of Consecrated Life and Societies of Apostolic Life, having carefully examined the matter, by this Decree, authorizes the union of the abovementioned Institutes into one Religious Institute of Pontifical Right.

The new Institute, with its principal seat in the Archdiocese of ______ in ______ (USA) will be called the ______.

All the Sisters forming part of this new Institute remain in the same condition of religious profession in which they are at present and a new religious profession is not required.

Furthermore, all goods, both movable and immovable, of the abovementioned seven Religious Institutes shall be duly ascribed to the new Religious Institute.

Special funds or pious bequests, if there be any, must be used for the purpose intended by the donor or testator; likewise, the rights of others, if there be any, must be preserved intact insofar as the case demands.

This Decree will become juridically effective on the ______ of ______, ______.

This Congregation for Institutes of Consecrated Life and Societies of Apostolic Life authorized that:

1. The First General Chapter of the New Institute will be celebrated during ______ and will be presided over by ______ until the election of the new Superior General.

2. Following the General Chapter, the new Constitutions will be submitted to this Congregation for Institutes of Consecrated Life and Societies of Apostolic Life for review and approval.

All things to the contrary notwithstanding.
